By accessing or using Track The Gym ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all users, including gym owners, administrators, staff members, and gym members.

Track The Gym is a gym management platform that provides tools for member management, payment processing, attendance tracking, and business analytics. The Platform is available via web dashboard, member portal, and mobile applications.

To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Track The Gym offers various subscription plans including a free tier. Paid subscriptions are billed on a monthly or annual basis. Prices are quoted in US Dollars (USD) unless otherwise stated. We reserve the right to change pricing with 30 days' notice. Refunds are handled on a case-by-case basis.

You agree to:

• Use the Platform in compliance with all applicable laws and regulations
• Not use the Platform for any unlawful or unauthorized purpose
• Not attempt to gain unauthorized access to any part of the Platform
• Not interfere with or disrupt the Platform or its servers
• Ensure that all data entered into the Platform is accurate and lawful
• Obtain proper consent before adding member data to the Platform

You retain ownership of all data you input into the Platform. Track The Gym does not claim ownership over your content. You grant us a limited license to use your data solely for the purpose of providing and improving our services. You may export your data at any time.

The Platform, including its design, features, and content, is owned by Track The Gym and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

We strive to maintain 99.9% uptime for the Platform. However, we do not guarantee uninterrupted access and may perform scheduled maintenance with advance notice. We are not liable for any downtime or service interruptions beyond our reasonable control.

To the fullest extent permitted by law, Track The Gym shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform.

Either party may terminate the agreement at any time. Upon termination, your access to the Platform will be revoked. You may request an export of your data within 30 days of termination. After 30 days, we reserve the right to delete your data from our systems.

We may update these Terms of Service from time to time. We will notify you of any material changes via email or through the Platform. Your continued use of the Platform after changes constitutes acceptance of the updated terms.

These Terms of Service are governed by applicable international law. Any disputes arising from these terms shall be resolved through arbitration or in the jurisdiction where the dispute arises.
